These Terms of Service ("Terms") govern your use of the Automatic Monday website and services provided by Jones CBC LLC DBA Automatic Monday ("Automatic Monday," "we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms.
1. Services
Automatic Monday provides done-for-you lead response automation services, including AI-personalized SMS and email follow-up, appointment booking automation, dead lead reactivation campaigns, and performance reporting. Specific deliverables and timelines are defined in a separate client agreement or service order executed between Automatic Monday and each client.
The interactive demo tool available on our website is provided for informational and demonstration purposes only. Responses generated by the demo tool are illustrative examples and do not constitute a guarantee of performance for any specific business.
2. Use of the Website
You may use our website for lawful purposes only. You agree not to:
- Submit false, misleading, or fraudulent information through any form on our site
- Attempt to gain unauthorized access to any part of our systems
- Use automated tools to scrape, copy, or extract content from our site
- Use our demo tool to generate content for commercial purposes outside of evaluating our services
3. Intellectual Property
All content on automaticmonday.com, including copy, design, graphics, and the structure of the demo tool, is the property of Jones CBC LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
4. Client Engagements
Paid client engagements are governed by a separate written agreement. These Terms apply to website use and do not supersede any executed client contract. In the event of a conflict between these Terms and an executed client agreement, the client agreement controls.
5. 60-Day Performance Guarantee
As stated on our website, Automatic Monday offers a 60-day performance guarantee for Core and Pro clients: if the system does not demonstrably improve lead response time and generate at least one recovered opportunity within 60 days of go-live, we will refund the first month's retainer. Specific terms, definitions of "recovered opportunity," and the refund process are detailed in the client agreement. This guarantee applies only to clients who have completed onboarding and provided necessary access to their lead intake channels.
6. Disclaimer of Warranties
Our website and demo tool are provided on an "as is" basis without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or that the demo tool will produce results representative of actual system performance for your specific business.
ROI estimates shown in the calculator on our website are based on published industry research and reasonable assumptions. They are illustrative only and do not constitute a guarantee of revenue recovery.
7. Limitation of Liability
To the fullest extent permitted by law, Automatic Monday and Jones CBC LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services, even if advised of the possibility of such damages. Our total liability to any party shall not exceed the amount paid by that party for services in the three months preceding the claim.
8. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Denver, Colorado.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of our website after changes are posted constitutes acceptance of the revised Terms. We will update the effective date at the top of this document when changes are made.
